Introduction

By accessing or using this website, you (the “Customer”) indicate your unconditional acceptance of these Terms of Use (“Terms of Use”). Skullies reserves the right, in its sole discretion, to update or revise these Terms of Use at any time. Your continued use of the site following the posting of any changes constitutes acceptance of those changes. When you purchase items on our site, you enter into a binding agreement governed by these Terms of Use.

This website is governed by the laws of South Africa.

Minimum Requirements

By placing an order on this website, you confirm that you have the legal capacity to enter into a contract with Skullies (including being of legal age and having the authority to use the payment method selected).

Effect

These Terms of Use override any separate terms put forward by you. Any conditions submitted by you in any form are expressly excluded. No changes to these Terms of Use shall be binding unless agreed in writing and signed by Skullies.

Sales and Pricing

Upon receipt of payment, all terms and conditions become final and binding.

Final checkout prices displayed are inclusive of taxes and standard delivery fees where applicable. You agree to pay the price displayed at checkout for the products selected.

Skullies reserves the right to adjust prices at any time until an “Acceptance of Order” notice is issued. If the final price differs from what was shown at checkout, you may request a full refund instead of paying the difference.

Your order remains an offer until formally accepted. Order confirmations sent by email or other methods are for information purposes only and do not constitute acceptance. Delivery of the order also constitutes acceptance.

Prices listed on www.skullies.com are in South African Rand (ZAR) unless otherwise indicated.

Payment Methods

Card transactions

Card payments will be processed via Paygate, an approved and secure payment gateway supporting South African acquiring banks.

Payfast uses advanced SSL encryption and adheres to PCI-DSS standards to ensure the protection of your payment information. No card details are stored on our website or servers.

General Payment Terms

You must pay for the product in full at the time of ordering unless using an approved installment method.
We may request additional verification before releasing your order.
We reserve the right to reject or restrict certain types of payments.
We are not obligated to supply any product before payment reflects in full.
All information provided at checkout must be complete and accurate. Costs arising from incorrect details will be for the customer’s account.

If you make an error in your order, contact orders@skullies.com immediately. We cannot guarantee that amendments can be made once processing has begun.

For orders with multiple items, Skullies reserves the right to supply only the available items and refund items not supplied.

Delivery & Returns

Skullies aims to deliver products to the delivery address provided at checkout.

Delivery times differ based on promotions, product types, and destination. Estimated delivery times are available on our “Orders & Delivery” page. We will notify you if we anticipate delays but are not liable for losses arising from late delivery.

On Delivery

You may be required to sign for the package.
Inspect items before signing.
Retain receipts for future reference.

If delivery to your address is not possible, Skullies may cancel the order or request an alternative address.

Risk and Ownership

Ownership and risk pass to you:

When delivery is completed, OR
When delivery is attempted but fails due to your unavailability or an incorrect address.

Damage from improper opening (e.g., using sharp tools) is your responsibility.

Redelivery Fees

If not available during delivery attempts, any redelivery fees may be charged to the customer.

Right to Cancel Delivery

Skullies may cancel the order anytime before successful delivery.

Return Policy

Return shipping (to and from our warehouse) is the customer’s responsibility unless the product is faulty.
Returns are accepted if the product is faulty or you changed your mind (subject to our returns conditions).

You are responsible for reviewing the return policy at checkout.

Turnaround Times

International Orders

Custom Skullies items will be completed and ready to ship 6 months from the date of payment and confirmation.

RSA Orders

Stock Skullies: 7-day turnaround from date of payment clearance.
Custom Skullies: 6 months from date of payment and confirmation.

Important:

Shipping/courier costs are not included and are billed to the customer.
Skullies is not responsible for goods in transit.
Prices are subject to change without notice.
Accepted quotes remain fixed regardless of exchange rate fluctuations.
Digital scanned custom Skullies files remain property of Skullies.
All Skullies are hand-painted; variations in finish should be expected.

Cancellation

Skullies reserves the right to refuse payment or cancel any sale if fraud is suspected or if the product is unavailable. Any payments received will be refunded via the original payment method unless fraud is suspected, in which case relevant authorities may be contacted.

Force Majeure

Skullies will not be liable for delays caused by circumstances beyond its control (e.g., natural disasters, strikes, customs delays). Reasonable extensions may apply.

Product Dead on Arrival (DOA)

Products are delivered in new or original condition unless stated otherwise.

If you believe the item is not in original condition:

Contact orders@skullies.com immediately.

Signing for a delivery confirms that the visible condition of the product is acceptable.

Security

Any attempts to deliver malicious code to the site or gain unauthorized access will result in prosecution and claims for civil damages.

Your login details must remain confidential and for your personal use only.

Skullies takes all reasonable precautions to secure its site and infrastructure.

Payment pages are encrypted with SSL and additional security protocols. Skullies does not access or store any confidential payment information.

Skullies will take all reasonable steps to protect personal information in compliance with the Promotion of Access to Information Act (PAIA).

Disputes

Any disputes between you and Skullies will first be handled amicably. If unresolved, disputes may be escalated according to South African law.
